- GENERAL
1. AGREEMENT
By accessing this Portal or using any of the services provided through this Portal (the "Services"), you agree to accept and comply with these Terms and Conditions of use (the "Terms and Conditions"). If you do not agree with any term or condition, you must immediately exit and stop using this Portal. These Terms and Conditions may be revised from time to time. It is your sole responsibility to check for revisions. Your continued use of this Portal after any revisions to these Terms and Conditions are posted to this Portal shall constitute your acceptance of such revisions.
2. REGISTRATION
Access to this Portal and use of Services requires registration. You must be an existing Manitoba Hydro customer to register to use the Services. You agree to provide accurate and current information as required for such registration and to update your information in a timely manner to ensure it remains accurate and complete. When signing up for the Portal and the Services you agree to receive your Manitoba Hydro bill electronically and acknowledge that you will no longer receive a paper copy of your energy bill. If you would like to continue to receive a paper copy of your Manitoba Hydro energy bill you may indicate that preference in the Portal settings.
3. YOUR RESPONSIBILITIES
You have the sole responsibility to timely access the Portal and use the Services to access and check your monthly bills for amounts payable. In the event that you cannot access the Portal or use the Services at any time to check your billings, please immediately contact Manitoba Hydro at (204) 480-5900 or 1-888-624-9376 for the balance on your account. You are solely responsible to maintain the confidentiality of any personal identifiers or passwords required for you to access this Portal or use any Services and for all activities that occur under such personal identifier or password. You agree to immediately notify Manitoba Hydro of any unauthorized use of your personal identifier or password. You are also solely responsible to maintain the confidentiality, to your requirement, of any of your account-related information that you download or otherwise extract from this Portal or Services.
4. PRIVACY AND SECURITY
For information on how Manitoba Hydro deals with your privacy and security of information, please refer to Manitoba Hydro's Privacy and Security Statement, which is incorporated into and forms part of these Terms and Conditions.
5. OWNERSHIP AND INTELLECTUAL PROPERTY
This Portal and the Services and all contents thereof, including, but not limited to, all text, images, screenshots, etc. (collectively the "Content"), are owned and protected intellectual property of Manitoba Hydro or other third parties with all rights reserved. Except as expressly provided, nothing herein or within the Portal or any of the Services shall be construed as granting to you any license under any of the intellectual property rights of Manitoba Hydro or any third party, whether by implication, waiver, estoppel or otherwise.
6. LIMITED LICENSE
This Portal and the Services are provided for your personal informational use only as authorized herein or as otherwise provided in the Portal or any Services. You are granted a limited license to use (display or print) short extracts of the Content for your personal informational use only, provided such Content is not modified in any way. Any other use of the Content is prohibited. You shall not market, commercially exploit, reproduce, copy, download, derivatize, modify or distribute any Content, this Portal or any Services, in whole or in part, without Manitoba Hydro's written permission. You further agree not to adapt, translate, modify, decompile, disassemble, or reverse engineer any software, applications or programs used in connection with this Portal or any Services.
7. CONTENT
While reasonable efforts are made to ensure that the accuracy of the Content provided through this Portal, if there is any discrepancy in information between Content and records kept by Manitoba Hydro, you agree that records kept by Manitoba Hydro in regard to any Content, including the balance of your account(s) with Manitoba Hydro, shall take precedence and shall be conclusive evidence of the matters recorded, provided, however, that the failure of Manitoba Hydro to record or correctly record any amount or date shall not affect your obligation to pay any outstanding balance that you have with Manitoba Hydro.
8. RULES OF USE
You agree that in accessing or using the Portal or any Services, or in submitting any information or materials to Manitoba Hydro, you shall: (i) act in compliance with all applicable laws and regulations; (ii) not attempt to damage, modify, alter or deface any part of this Portal or any Services or any Content; (iii) not post, transmit, link to or otherwise distribute any information or software which contains a virus, or other harmful or disruptive, property or component that may adversely affect any computer systems or programs, the Portal or the Services; (iv) not post, transmit, link to or otherwise distribute any inappropriate, defamatory, indecent or unlawful material or information; and (v) not impersonate, or falsely represent your association with, any person. You must take reasonable and appropriate precautions to ensure that any computer system used to access this Portal or any Service is secure and free of viruses or other harmful or destructive properties or components.
9. THIRD PARTY CONTENT
As a convenience to you, this Portal may contain links to other internet sites that are operated by other parties that are not under the control of Manitoba Hydro. Manitoba Hydro and its affiliates, agents, officers, contractors, etc., are not responsible for the availability or content of such third-party internet sites. Third party links are referenced for information and interest only and you agree that Manitoba Hydro and its affiliates, agents, officers, contractors, etc., are not affiliated with and do not represent or endorse any such third party or its products or services. Your communication or business dealings with any third parties found on, or through the Portal or any of the Services, are solely between you and such third parties at your sole risk.
10. MODIFICATIONS AND TERMINATION
Manitoba Hydro reserves the right to suspend, discontinue, terminate or modify any aspect of the Portal, Services or Content and/or your access or use thereof at any time for any reason whatsoever with or without notice to you. Manitoba Hydro further reserves the right to refuse to post and the right to remove any information or materials, in whole or in part, that Manitoba Hydro deems, in its sole discretion, to be inappropriate, unlawful or in violation of these Terms and Conditions. If you are dissatisfied with the Portal, any of the Services or any Content, or with any terms, conditions, rules, policies, or practices of Manitoba Hydro in operating the Portal and the Services, your sole and exclusive remedy is to discontinue using the Portal and the Services.
11. DISCLAIMER
THE PORTAL, THE SERVICES AND ANY CONTENT ARE PROVIDED SOLELY ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOUR USE OF SUCH CONTENT IS AT YOUR SOLE RISK. NO WARRANTY IS GIVEN THAT THE WEBSITE OR SERVICES ARE OR WILL BE ERROR-FREE, FREE OF VIRUSES OR OTHER HARMFUL OR DESTRUCTIVE PROPERTIES OR COMPONENTS, OR UNINTERRUPTED. MANITOBA HYDRO, AND ITS AFFILIATES, AGENTS, OFFICERS, CONTRACTORS, ETC., ARE NOT RESPONSIBLE FOR TRANSMISSION ERRORS IN, CORRUPTION OF, OR THE SECURITY OF CONTENT CARRIED OVER TELECOMMUNICATIONS CARRIERS' OR OTHER PROVIDERS' FACILITIES. THE CONTENT IS PROVIDED FOR YOUR PERSONAL INFORMATION PURPOSE ONLY. YOU AGREE THAT MANITOBA HYDRO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, FOR ANY LOSS OF USE, LOST DATA, LOST BUSINESS PROFITS, BUSINESS INTERRUPTION, PERSONAL INJURY OR PROPERTY DAMAGE, SUFFERED OR INCURRED BY YOU OR ANY PERSON CLAIMING THROUGH YOU ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE PORTAL, THE SERVICES OR ANY CONTENT, ANY COMMUNICATIONS TO AND FROM US, OR ANY SOFTWARE, INFORMATION OR DOCUMENTS CONTAINED IN OR ACCESSED THROUGH THE PORTAL OR ANY SERVICES, EVEN IF MANITOBA HYDRO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), EQUITY, STRICT LIABILITY OR OTHERWISE.
13. INDEMNITY
You agree to defend, indemnify and hold harmless Manitoba Hydro, its affiliates, directors, officers, employees and agents, from and against any and all losses, costs, damages and expenses, including reasonable legal fees, suffered or incurred by Manitoba Hydro from or related to your violation of these Terms and Conditions or your use of the Portal, the Services or any Content contained therein.

You can cancel this service at any time by texting "STOP" to 22888. We will send you a reply to confirm you are unsubscribed and will no longer receive SMS messages from us. To receive SMS notifications again, log into your online account and change the Notification Preferences under My Account.
Carriers are not liable for delayed or undelivered messages.
15. GENERAL
These Terms and Conditions form the entire agreement between you and Manitoba Hydro with respect to your use of this Portal, the Services and Content. Failure or delay by Manitoba Hydro to enforce the provisions of this agreement or Manitoba Hydro's rights or remedies at any time will not be construed to be a waiver of Manitoba Hydro's rights under this agreement and will not prejudice Manitoba Hydro's right to take subsequent action. If any provision in these Terms and Conditions is illegal, invalid or unenforceable at law, it shall be deemed to be severed from this agreement and the remaining provisions shall continue in full force and effect. The laws of the Province of Manitoba and the laws of Canada applicable therein shall govern as to the interpretation, validity and effect of this agreement, notwithstanding any conflict of laws provisions or your domicile, residence or physical location. You hereby consent and submit to the exclusive jurisdiction of the courts of the Province of Manitoba in any action or proceeding instituted in relation to this agreement.
